Lootme.eu Terms and Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE LOOTME.EU WEBSITE. By accessing, using or visiting WWW.LOOTME.EU, any of its content, functionalities and services, you signify your agreement to these Terms of Service and our Privacy Policy and incorporated herein by reference.

This document defines the legal (contractual) relationship between the User and LOOTME.EU.

I. DEFINITIONS

  1. Consumer – means any User, who is a natural person and who acts in the agreement covered by these Terms and Conditions for purposes, which are outside his/her trade, business, craft or profession.
  2. Electronic services - performance of the service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the recipient, sent and received by means of electronic processing devices, including digital compression, and data storage, which is entirely received or transmitted via telecommunications network.
  3. LOOTME.EU - means the company behind online store located on domain www.lootme.eu and alternative domain www.lootme.cz , operator of the online store is a business entity:

  4. Site / Store – means lootme.eu website of the online store, available on the Internet at: www.lootme.eu or www.lootme.eu domain name.
  5. Chest – means a virtual chest containing variety of products in different Qualities presented on the Site from which the User may receive one (1) of the following products:
    • “Common quality“ Coupon for an activation key to video games or other products available
    • “Uncommon quality“ Coupon for an activation key to video games or other products available
    • “Rare quality“ Coupon for an activation key to video games or other products available
    • “Epic quality“ Coupon for an activation key to video games or other products available
    • “Legendary quality“ Coupon for an activation key to video games or other products available

    Technical requirements related to a given video game shall be available on the Site or at http://store.steampowered.com/.The digital key to a video game can be activated solely on Steam platform. 

  6. Coupon - means a virtual coupon, through which the user can obtain a product associated with the coupon. To obtain the product, the user must redeem the coupon by clicking on the corresponding button in their user account. (Claim the Product)
  7. Key - means a digital product that can be bought on the Store, it is used for Unlocking the Chests presented on the Site, there are four different type of keys. (also referenced as Quality of the Key)
    • Common Key
    • Uncommon Key
    • Rare Key
    • Epic Key

    One Key can open only one Chest chosen by User. After the User used it for Opening the Chest, the key will be deleted.

  8. Unlocking the Chest / Opening the Chest - means that User who opens a Chest he or she chooses on the Store will receive one (1) of the products presented in the Chest in form of a Coupon. The product from the Chest is chosen by LOOTME.EU. LOOTME.EU follows this set of rules when choosing the products:
    • If the chest is opened by a Common Key, the chosen product will be one item from the chest.
    • If the chest is opened by a Uncommon Key, the chosen product will be one item from the chest with listed quality “Uncommon, Rare, Epic or Legendary”.
    • If the chest is opened by a Rare Key, the chosen product will be one item from the chest with listed quality “ Rare, Epic or Legendary”.
    • If the chest is opened by a Epic Key, the chosen product will be one item from the chest with listed quality “Epic or Legendary”.

    Opening the chest without key using the “try me” button does not entitle the user to receive any product.

  9. Scrape the product - means a Coupon for the product will be exchanged for Key-part. The Quality of the Key-part differs based on the quality of the product. Quality of the exchanged Key-part will be the same as Scraped product Quality.
  10. Claim the product - means the User will use the Cupon for the product and get access to the product key (Game Key) of the claimed product. The User can then use the Game Key for activating the product in the Steam Platform.
  11. Common, Uncommon, Rare, Epic, Legendary (Quality) - means a type of product, Key or Key-part. There are five quality levels.
    1. Common
    2. Uncommon
    3. Rare
    4. Epic
    5. Legendary
  12. Key-part - means a virtual product used for exchanging for a Keys. Users can get Key-parts by Scrapping Products from Chests. Key-parts can be exchanged for Keys using this trade table.
    • 3 Common Key-parts = 1 Uncommon Key
    • 3 Uncommon Key-parts = 1 Rare Key
    • 3 Rare Key-parts = 1 Epic Key
    • 5 Epic Key-parts = 2 Epic Keys
    • 2 Legendary Key-parts = 6 Epic Key
  13. Game-key / Product-Key / License-Key - means a product key used for activation of the product on Steam Platform.
  14. Privacy Policy / Privacy and Cookies Policy - means privacy policy a document available at https://www.lootme.eu/en_US/privacy-policy
  15. User – means any person, legal or natural who participates in the lootme.eu website; the User being a natural person shall be at least 18 years old (or shall reach age which in light of applicable domestic law entitles him/her to execute legally binding agreements), has full capacity to take legal actions and agrees to obey these Terms and Conditions. Should the User act for and on behalf of a third party being a legal person, a so called non-corporate legal entity etc. – they hereby assert LOOTME.EU that he/she is authorized to commit, enter into obligations and incur any liabilities related to the execution of this agreement for and on behalf of such person, and the acceptance of these Terms and Conditions by such User is of the same effect as if they were accepted by such third party.
  16. Account – an account kept on the Site for a User, enabling the User to use the services offered through the Site and benefit from its full functionality.

II. GENERAL PROVISIONS

  1. Participation on the Site is intended only (i) for the User who is eighteen (18) years old or over at the time of entry and is not under guardianship or custody,
  2. The Site is intended only for Users where in their place of residence and/or habitual residence participation in this kind of program is permitted by law without any additional requires licenses, permits or other approvals.
  3. Acceptance of these Terms and Conditions is a condition of rendering LOOTME.EU services.
  4. The LOOTME.EU provides Users with free of charge the following Electronic services:
    1. Site
    2. enabling viewing of content placed as part of the Site
    3. account
  5. Minimum technical requirements necessary for using the site properly:
    1. access to e-mail
    2. computer, laptop, or other device with Internet access with a minimum screen resolution 1366px x 768px and web browser with support enabled Cookies and JavaScript, one from:
      • Mozilla Firefox 65 or newer
      • Microsoft Edge 44 or newer
      • Opera 58 or newer
      • Safari 12 or newer
      • Google Chrome 72 or newer
  6. LOOTME.EU processes personal data in the scope necessary to entering into and performing these Terms and Conditions. Specific rules including grounds, rights relating to personal data processing are included in Privacy and Cookies Policy which constitute a separate document.
  7. The User is obliged to the prohibition on abuse of electronic means of communication and to provide the following content to LOOTME.EU:
    1. causing work disturbance or overloading of IT systems
    2. incompatible with universally applicable law,
    3. violating third party rights, including copyright, intellectual property rights or personal rights,
    4. provide unlawful content.
  8. If there are problems or irregularities in connection with using the LOOTME.EU service the User may submit a complaint by sending it to the following address: support@lootme.eu. In the complaint, the User should include his/her name and surname, e-mail address (or other correspondence address), the subject of the complaint and the reason for the complaint. The complaint will be considered immediately, however not later than within 30 days of its receipt. The person submitting the complaint will be informed about the method and result of the complaint consideration to the correspondence address or to the e-mail address.

III. RULES OF THE LOOTME.EU Online Store

  1. Under LOOTME.EU in the Store, the User has an opportunity to purchase variety of Keys, each key can be exchanged for one (1) product in a form of Coupon presented in the given Chest during “Opening the Chest”. LOOTME.EU is fully entitled to introduce limits for the availability of the Chest and the number of its openings by the User.
  2. User can also get Keys as a gift from other Users or directly from LOOTME.EU.
  3. User can send a Key to a different user only by using a specific buttons in his/her account, sharing the User account is not permitted. Once the key is given, the key is blocked for use, until the gifted User accepts the gift or the giving User cancels the gift. During this period while the key is blocked, the owner of the Key is the giving User. Once the key is accepted by the given User the owner of the Key is given User. LOOTME.EU is not responsible for any loss that can happen to User if the User loses his or her keys for any reason. Make sure to keep your Users credential safe and don't share it with anybody. 
  4. Once the Key is used for Opening the Chest, the Key is deleted and cant be used anymore.
  5. Once the User Opens the Chest, the product in form of a Coupon he/she will get for exchange will be able to Claim or Scrap in his Users account. The User can choose if he want to claim the product and get a Game-key or the user can Scrap the product and make a Key-part. 
  6. If the User chooses to claim the product, the User will get a Game-key which he or she can use on the Steam platform to activate the product.. Once the user claims the product, he is not able to Scrap the product anymore.
  7. If the User chooses to Scrap the product, the User loses all rights to own the product, he or she will not get any Game-key, but instead the User will get a Key-part in the same quality as the product he Scraped.
  8. Key-parts can be exchanged for Keys. Exchange rates are specified in section I. 12.
  9. The Quality and type of products deposited in a Chest may vary, however, it shall be always presented on the Site.
  10. The User may not use any products or services available on the Site for any illegal or unauthorized purpose nor may he/she violate any laws in his/her jurisdiction (including but not limited to copyright laws).

IV. USER'S ACCOUNTS

  1. The User's account is conducted solely by LOOTME.EU.
  2. In order to set up his/her account, the User is obliged to register by filling in the registration form available on the Site. During registration, the User is prompted to supply his or her current email address, User's name and password, as well as to accept LOOTME.EU Terms and Conditions and Privacy Policy. If it is discovered by LOOTME.EU that the User utilized email address which was created by the User with intent that the given email address will be in existence for a limited period (e.g. a so called disposable email address), LOOTME.EU reserves the right to suspend User's account. If the User's account is suspended, everything on this Users Account including Keys and Key-parts on the said account may be fortified. LOOTME.EU may, at LOOTME.EU's sole discretion, re-activate such account.
  3. Each User shall disclose his/her place of residence (headquarter or place of habitual residence) during each payment process. The User takes note and accepts that LOOTME.EU is in possession of tools which detect the localization of computer network device (and its connection), as regards the country of origin from which the order is performed. In case of discrepancies between the place of residence, headquarter or place of habitual residence indicated by the User in the payment process and the results of verification made by LOOTME.EU, in particular on localization of computer network device (and the connection) as regards the country of origin from which the order is performed, LOOTME.EU shall be entitled to refuse to complete the order. Notwithstanding the foregoing the User also agrees on the aforesaid localization verification during visiting the Site and undertakes to provide LOOTME.EU with all information in this respect. The User is entitled to set up only one account, unless LOOTME.EU gives individual permission. For the avoidance of doubt, the User will not use VPN connection during the use of Site.
  4. The User is obliged to exercise reasonable care to ensure that an updated email address is always assigned to his account on the Site.
  5. In case of violation of these Terms and Conditions and/or the law in force by the User, LOOTME.EU reserves the right to block the User's account and take any necessary actions as are required by law.
  6. Within the scope permitted by law, LOOTME.EU reserves the possibility of temporary unavailability of access to accounts, which may occur due to conducted modernization works or technical problems. If any technical problems arise, LOOTME.EU hereby commits to deal with them as soon as possible.
  7. The User acknowledges that sharing his/her account with other people or giving access to persons other than the User's personnel may cause irreversible damage to LOOTME.EU. The User is obliged to protect LOOTME.EU and its partners against losses and damage caused by the use of their account by third parties.
  8. In order to obtain the product, the User is obligated to follow the information provided accordingly on the Site during the usage of the Site.
  9. The User may not provide LOOTME.EU with unlawful content.
  10. The account is made available to the User by LOOTME.EU free of charge and allows him or her to use the services offered through the Site, which is possible via the Internet network.
  11. Registration on the Site by the User is equivalent to the User having read, understood and accepted the Terms and Conditions in full, including the Privacy and Cookies Policy. Notwithstanding the above, the User who has not registered on the Site is also regarded as having accepted the Terms and Conditions and the Privacy and Cookies Policy at the moment he or she chooses to use any of the functionalities of the Site.

V. PAYMENTS

  1. To the extent permitted by law, LOOTME.EU shall not be liable against the User for any problems related to payments for which the owners of such sites are responsible, in particular for any delays in processing payments or the inability to process them due to technical reasons. In such cases, the User shall contact the applicable operator of the payment site in accordance with that site's terms and conditions. If the payment has not been accepted due to LOOTME.EU fault, the User shall inform LOOTME.EU thereof by sending an e-mail to the address: support@lootme.eu.
  2. The User asserts that he/she uses funds coming from legal sources.

VI. DELIVERY OF THE PRODUCTS

  1. Keys purchased directly from the Store are delivered instantly to the User's Account once payment has been processed.
  2. Coupons for the products are delivered instantly to the User's account after exchanging a Key for a Coupon while Opening a chest.
  3. Key-parts are delivered instantly to the user's account after exchanging a Coupon for them while Scrapping a product.
  4. Products such as Game-keys are typically delivered instantly or within 5 minutes to the User's Account after Claiming the product with a Coupon. However, there are some exceptions:
    1. a) EU reserves the right to withhold delivery of a game key for up to 72 hours in cases where LOOTME.EU evaluates, using internal tools, that the previous payment(s) associated with the user's account may potentially be unauthorized. This measure protects both the user and LOOTME.EU against misuse of third-party payment data. If the user believes that the withholding is unjustified, they may contact LOOTME.EU via email or phone to expedite the review.
      b) In exceptional circumstances, it may happen that a product is out of stock. In such cases, LOOTME.EU reserves the right to withhold delivery of the game key for up to 24 hours, or to refund the User with the Key in Quality of the product that is out of stock or refund the User with Keys with a value worth of the product, instead of delivering the Game-key for that specific product.
  5. If the product is in a pre-order state, the LOOTME.EU will withhold the ability to Claim of the product until the product will be available for sale. User will be noticed by User's email when the product will become available to claim. These products are always labeled with PRE-ORDER mark in detail of the product.
  6. The products obtained by Claiming a product contain digital content, such as Game-keys. LOOTME.EU will not deliver the product to the User on a physical medium, but instead will provide the User with an activation (license) key (Game-key) displayed on the site and sent to the User's email.
  7. If the User does not claim the product on the site within one year of obtaining the Coupon from Opening a chest for a given product, the Coupon may be automatically exchanged for a Key-part, as if the User had Scrapped the product themselves.

VII. LIABILITY

  1. LOOTME.EU is responsible for the proper performance of this agreement, including proper delivery of Keys, Key-parts, Coupons and Game-keys, however, LOOTME.EU shall not be liable for any quality and technical failure of a given game/product to which the products may be used.
  2. LOOTME.EU is not responsible for region, language or any other upcoming restriction regarding the given video game for which the Keys, Coupons, Key-parts, Chests or related products may be used. The User is obliged to familiarize themselves with description of the given video game provided on the Site or on Steam platform.
    LOOTME.EU shall have no liability for issues encountered with downloading, activating or using the Keys, Key-parts, Coupons, Game-keys, Chests or related products due to factors beyond their control, including the User's computer performance and speed of User's internet connection.
  3. LOOTME.EU User agrees to indemnify, defend and hold LOOTME.EU and their subsidiaries harmless – including affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees - from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of the User's breach of these Terms and Conditions or the User's violation of any law or the rights of a third-party.
  4. LOOTME.EU is not responsible for any bugs or errors on the Site, including interruption or malfunction of the Site, due to force majeure, planned activities related to ongoing maintenance of the Site, server failures, unauthorized acts of third parties, external service provider or any acts or omissions causes by the User. LOOTME.EU makes the utmost effort to keep the Site functioning properly.
  5. LOOTME.EU is not responsible for problems connected with obtaining information such as Game-keys to the products sent via e-mail resulting from the inappropriate User's e-mail, e-mail server settingsl or the e-mail account of the User and their individual configuration of the security of the computer or an e-mail program.
  6. LOOTME.EU services (or any other functionalities incorporated into the Site) can be various for different countries or regions. No guarantee is given to the effect that service or the functionality of a certain type of reach will be available to all Users. LOOTME.EU may, at its absolute discretion, restrict, decline or create another level of access relating to the use of services (or any other functionality incorporated into the Site) for different individual Users.
  7. LOOTME.EU informs that the use of the services provided by electronic means through the Internet is risky. The basic threat to every Internet user, including those using electronic services, is the ability to infect a teleinformatic system through various types of software designed primarily to inflict damage, such as viruses, "worms" or "Trojan horses". To avoid the risks associated with this, it is important for the User to equip his or her Internet connection with an antivirus program and constantly update it by installing its latest versions. It is also advised to the User to use various means, including common sense, in order to assure his safety.

VIII. COMPLAINS

  1. LOOTME.EU be liable to the User for any defects in Key. The defect in the Key means that they may not be used to exchange them for a Coupon of a product during Opening the Chest on the Site due to their malfunction.
  2. LOOTME.EU be liable to the User for any defects in Key-parts. The defect in the Key-parts means that they may not be used to exchange them for a Key on the Site (Exchange rates are specified in section I. 12. ) due to their malfunction.
  3. In order to exercise the rights of the User regarding defects in any services on the Site shall contact LOOTME.EU on email support@lootme.eu . LOOTME.EU shall make the utmost effort to resolve the User's problem.
  4. The rights and obligations of the parties regarding rights for defective performance are governed by the relevant binding legal regulations, provisions of Sections 1914 to 1925, Sections 2099 to 2117, Sections 2121 to 2125, and Sections 2161 to 2174 of the Czech Civil Code.
  5. The seller is liable to the buyer that the Keys are free from defects upon receipt. The seller is liable to the buyer in particular for the fact that, at the time when the buyer took over the Keys,
    1. the Keys have the properties, Quality that were agreed upon, and if there is no agreement, the Keys have such properties that the LOOTME.EU described
    2. the Keys are suitable for the purpose that the LOOTME.EU specifies onSite in this Terms and Conditions
    3. the Keys are in the appropriate quantity
  6. The User is entitled to a refund within 14 days of purchasing the product (Key). However, if the purchased Key has already been used to Open a Chest, the right to a refund or any other warranty claim for this product is forfeited. The User acknowledges that the Key is a digital product for one-time use, and its properties do not allow for multiple uses. Once the Key is used, it is considered used and destroyed.
  7. If the User owns multiple Keys of the same quality, the Key used to open the Chest will be the one that has been on the User's account for the longest time at the time of use, or the one that the User purchased first. First, the purchased Keys are used, followed by the Keys created by combining Key-parts.
  8. THE USER IS NOT ENTITLED TO REQUEST ANY REPLACEMENT, REFUND OR PRICE REDUCTION for a product or Coupon for the product that was selected by LOOTME.EU from a chest during the Opening of the chest, except for reasons that the product does not meet the minimum Quality corresponding to the used Key, according to the rules in section I. 8. 

IX. WARRANTY

  1. LOOTME.EU guarantees that the provided License-keys correspond to the given product on the Steam platform in accordance with the product description on the LOOTME.EU store website.
  2. LOOTME.EU guarantees that the License-keys for Steam games are functional at the time of delivery and for a period of at least 30 days from the day the License-key was provided to the User on the Site or via email. To minimize the risk of License-key being stolen, we recommend that Users apply the License key as soon as possible after he/she receives it. LOOTME.EU is not responsible for what happens to the License-key after it has been provided to the User. If the License-key is applied at a time when the Key has already been provided to the User, it is not possible to request a refund, Key replacement or any other guarantees. Please secure your network, email, computer or other devices that you are using.
  3. In case an error is detected with the License-key used for a game on Steam, the User can request correction of the error. If correction is not feasible, the User has the right to compensation through a License-key exchange or a refund of the Key used to acquire the Coupon associated with the License-key. Please note that this does not cover errors caused after the License-key has been provided to the User.
  4. LOOTME.EU provides a standard warranty for Keys purchased through the store as said in section VIII. 5, but only until these Keys are used for Opening a chest and thus destroyed. The User acknowledges that the Key is a digital product for one-time use, and its properties do not allow for multiple uses. Once the Key is used, it is considered used and destroyed.

X. GENERAL TERMS AND CONDITIONS REGARDING THE USE OF THE SITE

  1. All information, images, and logos on the Site are the property of LOOTME.EU or third parties. LOOTME.EU does not claim any ownership or copyright rights to this information, images, or logos of third parties. 
  2. LOOTME.EU may provide the User with access to the content, products or services offered by other providers via the hyperlinks (in the form of word links, banners, channels or whatever else) leading to the sites of such providers. It is recommended to read the regulations of such sites, their privacy policy and terms and conditions before starting to use such sites. The User is informed that LOOTME.EU has no control of the websites owned by other providers, nor doesLOOTME.EU monitor such sites or is it liable to Users for such websites, their content or the products or services that are available from such websites.
  3. The User is obliged to the prohibition on abuse of electronic means of communication and to provide the following content to LOOTME.EU:
    1. causing work disturbance or overloading of IT systems
    2. incompatible with universally applicable law,
    3. violating third party rights, including copyright, intellectual property rights or personal rights,
    4. provide unlawful content.

XI. FINAL PROVISIONS

  1. Should any provisions hereof prove to be invalid or ineffective, they will not affect the validity of the remaining provisions. Invalid or ineffective provisions will be replaced by such valid provisions which reflect the economic value, intention of the parties and objective of the invalid or ineffective provisions to the highest extent.
  2. LOOTME.EU reserves its right to make any changes and modifications to these Terms and Conditions, including the right to introduce new provisions and delete the previous ones, due to important reasons, in particular (i) a change in the scope of economic activity carried out by LOOTME.EU, (ii) the need to adjust the provisions of these Terms and Conditions to the applicable law, including case law of common courts or new resolutions, decisions, recommendations or other acts issued by the authorities authorized to issue binding regulations, (iii) in order to ensure proper functioning of the Site, (iv) introducing new products or services by LOOTME.EU, (v) modifying the functionality of products, services or service delivery methods due to technological considerations, (vi) and to ensure the safety and security of the User as well as (vii) to introduce new or changes to the existing rules of the service. In this case LOOTME.EU will revise this version of the Terms and Conditions. Date of revision will be included. User is obliged to check whether they agree with these terms and conditions every time they use the website. If the User does not accept the providing amendments to these Terms and Conditions, he or she is entitled to terminate the agreement, and then delete his/her account on the Site.
  3. These Terms and Conditions are governed by the laws of Czech Republic without reference to their conflicting provisions, unless the domestic law applicable to the User being a consumer provides otherwise. Parties approving these Terms and Conditions are exclusively subject to the jurisdiction of courts in Czech Republic, unless the domestic law applicable to the User being a consumer provides otherwise.
  4. These terms and conditions are available on this website in both English and Czech languages. Although the content of both versions should be identical, in case of any discrepancies in meaning or unclear interpretation of any point, the terms and conditions written in the Czech language shall prevail, and the English version shall be considered a derivative translation.
  5. The consumer buyer has the right to an out-of-court settlement of a consumer dispute arising from a purchase contract concluded with the seller. The subject of out-of-court settlement of consumer disputes is the Czech Trade Inspection Authority with its registered office at Štěpánská 567/15, Prague 2, Postal Code: 120 00, www.coi.cz .
  6. The seller is authorized to sell goods based on a trade license. The trade inspection is carried out by the relevant trade licensing office within the scope of its powers. The Office for Personal Data Protection supervises the area of personal data protection. The Czech Trade Inspection Authority carries out, among other things, supervision of compliance with Act No. 634/1992 Coll., on Consumer Protection, within a defined scope.
  7. By accepting these terms and conditions, the buyer assumes the risk of any change in circumstances within the meaning of Section 1765 (2) of the Civil Code - Czech Republic.
  8. All correspondence, documents and notifications shall be delivered to the electronic address of the buyer, and the day of delivery to the buyer shall be deemed to be the day of dispatch by the seller to the buyer's electronic address.
  9. These terms and conditions are valid and effective from June 30, 2023 and supersede all previous terms and conditions that are available at the seller's registered office.
